Article 2 — Purpose

These General Terms and Conditions of Sale govern sales made on the website www.lisa-pam.com between LEMON TREE and any adult individual acting as a consumer.

Any order implies full and unconditional acceptance of these Terms and Conditions of Sale.

Article 3 — Products

The website sells, in particular:

• the LISA-PAM connected device;
• LISA-Attract scent refills;
• compatible CO₂ kits;
• accessories required for the operation of the device.

The products are sold new and assembled in France. Photographs are provided for illustrative purposes only and have no contractual value.

Article 4 — Characteristics of the LISA-PAM Device

The LISA-PAM device is intended to help reduce the mosquito population present in an outdoor area. It does not constitute a device guaranteeing the complete absence of mosquitoes.

Its effectiveness depends in particular on: the installation location; compliance with the user instructions; weather conditions; local mosquito pressure; regular maintenance of the device; and the use of recommended consumables.

The seller does not guarantee any quantified result.

Article 5 — Scent Refills

LISA-Attract refills are scent-based consumables intended exclusively for use with the LISA-PAM device. They are not presented as biocidal products within the meaning of Regulation (EU) No. 528/2012.

Their effectiveness depends in particular on: climatic conditions; duration of use; storage conditions; and compliance with the manufacturer's recommendations.

Article 6 — Availability

Products are offered subject to availability. In the event of unavailability after order confirmation, the seller will inform the customer as soon as possible. The order may be cancelled and any amounts paid will be refunded.

Article 7 — Prices

Prices are displayed in euros including all taxes. Delivery costs are calculated during checkout. The applicable prices are those displayed at the time of ordering. LEMON TREE reserves the right to modify its prices at any time.

Article 8 — Orders

An order becomes final after: cart validation; acceptance of these Terms and Conditions; full payment.

The seller reserves the right to refuse an order in the event of a previous dispute or suspected fraud.

Article 9 — Payment

Payment is made exclusively by bank card. Payments are secured through the Stripe platform. No banking data is stored by LEMON TREE.

Article 10 — Delivery

Orders are shipped within 24 business hours. Delivery is handled by DPD. The average delivery time is between 48 and 72 hours. These timeframes are indicative only.

The seller cannot be held responsible for delays attributable to the carrier or cases of force majeure. Deliveries are limited to mainland France.

Article 11 — Transfer of Risks

Risks are transferred to the customer when the customer physically takes possession of the products.

Article 12 — Retention of Title

The goods remain the property of LEMON TREE until full payment of the price has been received.

Article 13 — Right of Withdrawal

In accordance with the French Consumer Code, the customer has fourteen (14) days from receipt of the products to exercise their right of withdrawal without having to provide justification.

The products must be returned:

• complete;
• in their original condition;
• with all accessories;
• in their original packaging.

Return costs remain the responsibility of the customer. Refunds will be made within a maximum period of fourteen (14) days after receipt and verification of the returned products.

Article 14 — Exceptions to the Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the following cannot be returned:

• LISA-Attract scent refills whose packaging has been opened;
• any consumable product whose packaging has been unsealed after delivery and which cannot be returned for hygiene or product protection reasons.

Article 15 — Legal Guarantees

The products benefit from the legal guarantee of conformity and the legal guarantee against hidden defects. No additional commercial warranty is offered.

Article 16 — Installation

The device is installed by the customer. The customer acknowledges having received the necessary installation instructions.

The seller cannot be held responsible for: incorrect installation; non-compliant connection; inappropriate location; lack of maintenance.

Article 17 — Use

The customer agrees to:

• follow the instructions provided;
• use only compatible accessories;
• use recommended consumables;
• not modify the device.

Any modification or dismantling voids applicable warranties within the limits provided by law.

Article 18 — Liability

LEMON TREE shall not be held responsible for:

• incorrect installation;
• improper use;
• insufficient maintenance;
• use of incompatible consumables;
• product modification;
• weather events;
• natural disasters;
• exceptional mosquito infestations.

The seller's obligation is an obligation of means and not of result.

Return costs are the responsibility of the customer unless a legal warranty applies.

Article 20 — Intellectual Property

All elements of the website are protected by intellectual property rights. Any reproduction, distribution, or use without written authorization is prohibited.

Article 21 — Personal Data

Personal data is processed in accordance with applicable regulations, including the General Data Protection Regulation (GDPR). A dedicated Privacy Policy is available on the website. Cookies are managed in accordance with the Cookie Policy available on the website.

Article 22 — Consumer Mediation

In the event of a dispute, the customer may submit a written complaint to customer service. If no amicable resolution is reached, the customer may refer the matter free of charge to the consumer mediator appointed by LEMON TREE, in accordance with Articles L.612-1 and following of the French Consumer Code.

Article 23 — Force Majeure

Neither party shall be held liable for failure resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code.

Such events include in particular: natural disasters; fires; pandemics; armed conflicts; strikes; widespread failures of transport or communication networks; administrative decisions preventing the performance of contractual obligations.

Article 24 — Applicable Law

These Terms and Conditions are governed by French law.

Article 25 — Disputes

In the absence of an amicable agreement, disputes shall be submitted to the competent French courts in accordance with the legal rules applicable to consumers.
